Terminating a tenancy – what every landlord needs to know

Some big changes to our tenancy laws were introduced early this year and we’re noticing there’s still some confusion, particularly when it comes to terminating tenancies.
In many ways the changes give landlords more flexibility when dealing with problematic tenants. However, they also bring tougher expectations when it comes to compliance and record-keeping.
Here’s a quick recap of what you need to know:
- Landlords can now serve a ‘no cause’ notice to end a periodic tenancy in 90 days without providing a specific reason.
- Landlords can now end a periodic tenancy with 42 days' notice in ‘specific circumstances’ including when they or a family member wishes to occupy to property or sell it with vacant possession.
- Tenants can now end a periodic tenancy with 21 days’ notice (down from 28).
- Landlords can now end a fixed-term tenancy at the end of its term without needing a specific reason - provided the correct notice is served.
- Both tenants and landlords can now give notice and send tenancy documents via email and instant messaging.
- Tenants are better protected against unjust evictions - they have longer to challenge their terminations and more support from Tenancy Services in enforcement.
